Jair Bolsonaro has been taken into custody after authorities concluded he posed a serious risk of fleeing while under home confinement.

The one-time leader was found guilty of planning a armed takeover in the ninth month and given more than 27 years in jail, but he continued under home detention pending court reviews.

Brazilian Supreme Court Justice the presiding justice said the move to detain the elderly politician was a safety action after "new facts" came to light.

This included attempting to break his ankle monitor and a summons to a public vigil that could facilitate a chance to flee".

Legal Document Reveals Escape Risks

In a document approving the custody, Justice Moraes said intelligence from the unit overseeing his home detention suggested the ex-president's plan to remove the tracking monitor to secure accomplishment in his flight.

This, it said, would be "facilitated by the disorder caused by the demonstration called by his child.

His child, his son Flávio, who works as a legislator, called for a gathering of his backers near the former president's residence to take place on Saturday evening.

His son wrote on social media on the previous day: "Are you going to fight for your nation, or observe everything from your smartphone there on your sofa? I call on you to fight with us."

He said the demonstration would be so backers could offer prayers for his well-being and for the return of democracy in our land."

Foreign Shelter Risks

Part of the magistrate's ruling was the potential of the former president's "relocation to embassies near the dwelling, considering that the probes revealed a background of arranging to request asylum through a diplomatic representation", a declaration said.

Latest Court Petitions

It was only on last Friday that the ex-leader's attorneys asked the Top Court to authorize him to serve his whole jail sentence under house arrest, with digital surveillance.

They also asked that Bolsonaro be permitted to exit his dwelling for medical care, saying he required regular treatment for pulmonary infections and other illnesses.

Background on Conviction

Bolsonaro was convicted of orchestrating a plot aimed at retaining his authority after he lost the presidential race to his ideological adversary, President Lula.

Supreme Court justices said that he knew of a plot which included plans to assassinate his opponent and his running partner, Alckmin, and to imprison and murder Alexandre de Moraes - the High Court judge who has been managing his judicial proceedings.

The conspiracy was thwarted because it couldn't obtain the support of the army and air force commanders. Lula was sworn in without problem on 1 January 2023.

But a week later, on January 8th, thousands of Bolsonaro supporters attacked and damaged public facilities in the federal district, the capital city.

The security forces intervened and around approximately 1,500 persons were arrested.

The magistrates found that the protesters had been encouraged by Bolsonaro whose plan, they said, was for the Brazilian military to step in, reestablish control and return him to office.

At the moment, the legal team called the over 27-year sentence "absurdly excessive.

He was also prohibited from running for public office until twenty-sixty - eight years after the conclusion of his imprisonment.

The former president called the court case a "witch hunt and said it was aimed at blocking him running in the 2026 national vote.
